Welcome to mDarasa. These Terms of Service ("Terms") constitute a legal agreement between you and mDarasa regarding your use of our website, platform, and services. By accessing, browsing, or using mDarasa in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms. 2. User Eligibility

By using mDarasa, you represent and warrant that:

• You have not been previously suspended or removed from mDarasa

3. Account Registration and Responsibilities

4. Course Enrollment and Payments

When you enroll in a paid course:

• You authorize us to charge the payment method provided
• You are responsible for all charges and fees associated with your enrollment
• Prices are subject to change with reasonable notice
• All transactions are non-refundable unless otherwise specified
• We are not responsible for declined payments or insufficient funds

For subscription services, your subscription will automatically renew unless cancelled before the renewal date. You can manage or cancel your subscription in your account settings.

5. Intellectual Property Rights

All content on mDarasa, including but not limited to course materials, videos, lectures, quizzes, and documentation, is the intellectual property of mDarasa or our content providers and is protected by copyright and other intellectual property laws.

You may access and use course materials solely for personal, non-commercial educational purposes. You may not reproduce, modify, distribute, display, or transmit course content without prior written permission from mDarasa.

6. User-Generated Content

If you submit, post, or display content on mDarasa (including comments, discussions, or assignments):

• You grant mDarasa a non-exclusive, royalty-free license to use that content
• You warrant that you own or have the right to the content you submit
• You are responsible for the accuracy and legality of your content
• You may not submit content that infringes on others' rights or violates any law

7. Prohibited Conduct

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, mDarasa SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS.

9. Disclaimer of Warranties

mDarasa and its content are provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding:

• The accuracy or completeness of course materials
• The platform will meet your specific needs
• The platform will be uninterrupted or error-free
• Any defects or errors will be corrected

10. Third-Party Links and Services

mDarasa may contain links to third-party websites and services. We are not responsible for the content, accuracy, or practices of external sites. Your use of third-party services is governed by their terms and conditions. We encourage you to review their policies before providing personal information.

11. Termination of Access

mDarasa reserves the right to suspend or terminate your account and access to the platform at any time, with or without notice, if you violate these Terms or engage in conduct we deem harmful or inappropriate. Upon termination, your right to use the platform ceases immediately.

We may update these Terms from time to time. Changes will be effective upon posting to the platform. Your continued use of mDarasa following any modifications constitutes your acceptance of the updated Terms. We will notify you of significant changes via email or prominent notice on the platform.

13. Academic Integrity

Violations of academic integrity may result in course suspension, account termination, and loss of enrollment privileges.

Certificates and credentials issued by mDarasa represent that you have completed a course and met the specified requirements. mDarasa certificates are for educational purposes only and do not constitute academic credit unless explicitly stated. The value, recognition, and acceptance of our certificates are determined by employers, educational institutions, and other third parties.

15. Indemnification

You agree to indemnify, defend, and hold harmless mDarasa, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from your violation of these Terms, your use of the platform, or any content you submit.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law principles. Any legal proceedings arising from these Terms shall be exclusively subject to the jurisdiction of the courts in Nairobi, Kenya.
